1. Agreement to Terms

By accessing or using the Sunsurf Capital website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services. These Terms constitute a legally binding agreement between you and Sunsurf Capital.

Sunsurf Capital is a direct business lender. We underwrite and fund business financing in-house. We make our own lending decisions, set our own rates and terms, and fund approved deals directly from our own capital.

3. Eligibility

Our Services are available to businesses operating within the United States. By using our Services, you represent that:

• You are at least 18 years of age
• You have the authority to bind the business entity you represent
• The information you provide is accurate, current, and complete
• Your business is legally formed and operating in the United States

4. Application Process

When you submit a financing application through our website:

• You authorize Sunsurf Capital to review your application information and obtain the credit and bank-statement data needed to evaluate your financing request
• You authorize our in-house team to obtain credit reports and verify the information you provide
• Submitting an application does not guarantee financing approval
• Any financing offer you receive is subject to Sunsurf Capital's terms and conditions and final in-house underwriting approval

5. No Guarantee of Funding

Sunsurf Capital does not guarantee that you will receive financing offers, that offers will meet your desired terms, or that your application will be approved. Funding decisions are made solely by Sunsurf Capital based on our own underwriting criteria.

6. Fees

Sunsurf Capital does not charge upfront fees, application fees, or consultation fees. We earn revenue through the interest and fees on the financing we provide. All fees, rates, and costs are set by Sunsurf Capital and disclosed to you in your funding agreement before you accept any offer.

7. Accuracy of Information

You agree to provide accurate, truthful, and complete information in all applications and communications. Providing false or misleading information may result in denial of your application, termination of services, and may constitute fraud under applicable law.

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Sunsurf Capital or our licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, Sunsurf Capital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, any lending decision made by our partners, or any financing product you accept. Our total liability for any claim shall not exceed the amount you paid to us for Services in the preceding 12 months.

You agree to indemnify and hold harmless Sunsurf Capital, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our Services, your violation of these Terms, or your breach of any representation made in your application.
